Democrat Rep. LaMonica McIver Faces Up to 17 Years for Assaulting ICE Officer

Tensions over Democratic participation in immigration enforcement disruptions escalated when a federal grand jury indicted Rep. LaMonica McIver (D-NJ) for allegedly striking a federal officer during an anti-ICE demonstration. If found guilty, McIver could spend up to 17 years behind bars.

McIver was accused of hindering federal law enforcement at an ICE facility in New Jersey on three felony counts. She and other Democrats from New Jersey, according to the prosecution, broke through facility gates and obstructed a detainee transport.

McIver intends to enter a not guilty plea and refers to the indictment as "political intimidation."

A federal grand jury indicted Rep. LaMonica McIver (D-NJ) on three felony counts of physically interfering with federal law enforcement officials during a protest at an Immigration and Customs Enforcement (ICE) detention facility last month. On May 9, during a contentious protest in New Jersey, McIver reportedly assisted in blocking a detainee transport bus and broke through a security fence, according to the accusation.

U.S. Attorney Alina Habba announced the indictment, claiming that McIver's acts constituted assaults on a federal ICE officer. McIver might spend up to 17 years behind bars if found guilty on all counts.

As Chief Federal Law Enforcement Officer for New Jersey, Habba wrote in a statement on X, "As I have said in the past, it is my constitutional obligation to ensure that our federal partners are protected when executing their duties." "People are free to voice their opinions about specific policies, but they must not do so in a way that puts law enforcement and the communities those officers serve in jeopardy."

Newark Mayor Ras Baraka and prominent New Jersey Democrats Reps. Rob Menendez and Bonnie Watson Coleman participated in the May demonstration. Habba pointed out that Baraka had "persistently made efforts to address these issues without bringing criminal charges" against McIver, even if the charges were eventually dropped against her "for the sake of moving forward."

McIver, known for her vehement criticism of federal immigration enforcement, vigorously contested the indictment and argued that it was motivated by politics.

"This indictment is an attempt by Trump's administration to avoid responsibility for the chaos ICE caused and to intimidate me out of carrying out the work I was elected to do," she said, adding that it was no more justified than the initial allegations. "But I won't be intimidated—it won't work."

Critics contend that the episode emphasizes the risks of elected officials publicly interacting with law enforcement, while her supporters portray her actions as an act of civic disobedience. McIver is now at the center of a widening divide between radical Democrats actively seeking to block immigration law and federal authorities attempting to enforce it.

McIver has stated that she plans to enter a not guilty plea. There is currently no scheduled court date.
