California in Violation of Title IX: Allowing Transgenders to Compete in Girls Sport

The Trump administration has warned California that it risks losing federal school funds unless it reverses its decision to allow transgender athletes to participate in girls' sports, citing the state's violation of Title IX.
According to federal inspectors, the present legislation in California "undermines fair competition" and disregards the rights of athletes who are naturally female. Titles earned by transgender athletes should be retroactively awarded to female competitors, according to the Department's resolution. The state was given a 10-day deadline to comply or risk losing federal school dollars, according to Education Secretary Linda McMahon.
Title IX, the federal statute that prohibits discrimination based on gender in education, is being directly violated by California's present policies that permit transgender girls to participate in female sports teams, according to a severe warning issued by the Trump administration's Department of Education to state officials. The news broke on Wednesday after two separate federal investigations into California's education department and the state's governing body for high school athletics, the CIF, respectively.
“The Trump administration will vigorously enforce Title IX safeguards for women and girls, and our findings today demonstrate that California has neglected its responsibilities under federal law," Education Secretary Linda McMahon stated emphatically. California faces severe repercussions, including the possible elimination of federal school funds, according to McMahon, unless it complies within 10 days.
The disagreement originated from California's acceptance of gender identity as a legal category for athletic competition, rather than a person's biological sex. The reaction from the Trump administration comes after an executive order that outlawed transgender athletes from participating in girls' and women's sports earlier this year. Athletes who are naturally female have their rights violated and fair competition undermined by California's regulations, according to the investigations.
A proposed resolution by the Department states that the state should mandate that all schools use biologically based definitions of "male" and "female." Transgender athletes would also have all of their accomplishments, including titles, records, and accolades, revoked. Then, the biological female athletes who had previously lost those accolades would have them restored to them. Additionally, the affected athletes in California would have to receive individual letters of apology from their respective institutions.
To accommodate high school junior AB Hernandez, who identifies as transgender, the CIF recently launched a contentious trial program during a May state track meet by allowing an additional competitor to compete in three events. President Trump publicly criticized Hernandez's inclusion and used social media to protest it, prompting that move. After initially focusing on the athlete's school district, the Justice Department has broadened its inquiry to include the entire state.
This decisive action contrasts sharply with the previous Biden administration's attempts to broaden the protections of Title IX to include gender identity. Just before Trump retook the presidency in January, a federal judge halted that reinterpretation.
No public response or indication of compliance from California officials has been given to the findings. A Justice Department lawsuit might be filed against the state with the goal of cutting off financing for education if it decides to ignore the federal mandate, as happened in a comparable instance involving Maine not long ago.
