The proposed legislation, which was previously introduced in the 118th Congress, would amend Title 28 of the United States Code. Proponents of the bill suggest that a 13-justice court would better align with the current 13 federal judicial circuits.

Markey emphasized that the change could be achieved through legislation rather than a constitutional amendment, noting that the size of the Supreme Court has been adjusted by Congress seven times throughout American history. The last such adjustment occurred in 1869, when Congress set the Court at its current size of nine members.
