Supreme Court 6–3 Decision Backfires Opening Alternatives for Increased Tariffs
By The Blog Source
President Trump condemned the Supreme Court on Friday, calling the justices "unpatriotic and disloyal to our Constitution" after a 6–3 decision ruled against his reciprocal and fentanyl-related tariffs, representing a significant setback to one of the cornerstones of his second-term economic agenda.
Trump said he was "ashamed of certain members of the court" for not having "the courage to do what's right for our country" while speaking from the White House briefing room. He was especially irritated with two judges he chose, Neil Gorsuch and Amy Coney Barrett, who joined the majority in declaring the tariff structure unconstitutional.Trump claimed that they were unfaithful to our Constitution and extremely unpatriotic. "I believe that a much smaller political movement and foreign interests have influenced the court than most people realize."
Trump also attacked the three Democratic-appointed justices on the court, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, saying they automatically disagreed with his trade policies. "Those justices are a disgrace to our country, to be honest," he added.
The ruling, which was delivered on Friday, concluded that Trump had overreached himself when he used his emergency powers to impose widespread international tariffs. With around $175 billion in collected revenue now owed, the decision essentially revoked his "Liberation Day" baseline tariff regime and paved the way for potentially enormous refunds.

Trump also blasted the decision's timeliness, pointing out that oral arguments were held in November. He said that the delay exacerbated the financial risk associated with refunds and prolonged uncertainty, saying, "They should have released this a long time ago." "There was uncertainty because we waited months."
According to the president, some justices were caving in to political pressure. "They're acting politically correct, which has happened far too frequently with some of this court's members," he remarked. "They're actually just being idiots and pawns for the radical-left Democrats and RINOs."
Additionally, Trump attacked opponents of the tariff system who opposed the government in court, calling them "obnoxious, ignorant, and loud" and implying that some judges were frightened by background noise. "They are unwilling to act morally. They fear it," he remarked.

Trump said he is not going to back down in spite of the loss. To reestablish a key component of his America First trade policy through alternative legal authority, he declared plans to proceed with a new 10% worldwide tariff under different trade legislation.
The decision sets up a high-stakes battle over who will ultimately decide American trade policy: a court demanding stricter statutory boundaries or the president elected on an economic nationalist platform. However, it is evident from Trump's comments that he sees the decision as a reset rather than a retreat. In only a few hours, he was announcing a new 10% worldwide duty under a different legal authority, indicating that the larger plan to put pressure on overseas rivals and boost domestic production would go forward, but with a different legal path.
