Dem. Rep. LaMonica McIver Charged for Obstructing Law Enforcement During ICE Protest

Rep. LaMonica McIver, a Democrat, is accused of attacking and impeding police during a demonstration at an ICE facility in Newark. The charge was made public on Monday by U.S. Attorney Alina Habba, who also stated that McIver turned down multiple opportunities to address the matter.
During the May 9th confrontation at Delaney Hall, McIver "assaulted, impeded, and interfered with law enforcement," according to Acting U.S. Attorney Alina Habba, in violation of Title 18, U.S. Code § 111(a)(1). "No one is above the law — politicians or otherwise," Habba said, emphasizing that she gave McIver "every opportunity to come to a resolution" before bringing charges. Ras Baraka, the mayor of Newark, who was detained that same day on suspicion of trespassing, will not face charges. The firing was decided "for the sake of moving forward," according to Habba.
Federal criminal charges have been brought against Democratic Representative LaMonica McIver of New Jersey for her actions during a heated altercation outside the Delaney Hall Detention Center in Newark earlier this month. McIver was charged with violating Title 18, Section 111(a)(1) of the U.S. Code by "assaulting, impeding, and interfering with law enforcement," according to Acting U.S. Attorney Alina Habba, who made the announcement Monday.
Things escalated when several Democratic politicians gathered outside the ICE-contracted facility on May 9th, leading to the arrest of Newark Mayor Ras Baraka for trespassing.
Habba, a former personal lawyer for President Donald Trump, emphasized that she had tried to avoid filing charges but had no other option. In a statement, she added, "I have consistently attempted to resolve these issues without filing criminal charges and have given Representative McIver every chance to reach a consensus, but she has regrettably declined."
Habba continued, asserting that all individuals, including politicians, are subject to the law. Regardless of who you are, this office's responsibility is to impartially enforce the law. We will now allow the legal system to function.
McIver denied the accusations, claiming that they were "purely political" and that ICE officers were responsible for intensifying the altercation. "I accompanied my colleagues earlier this month to examine the treatment of ICE detainees at Delaney Hall in my district," she stated. As members of Congress have done numerous times previously, we were carrying out our legal oversight duties, and our visit ought to have been brief and amicable. Instead, when ICE agents decided to arrest Mayor Baraka, they started an unsafe and needless altercation.
The accusation against Mayor Baraka has been withdrawn, but McIver is now facing legal action. "After careful deliberation, we have decided to drop Mayor Baraka's misdemeanor trespass charge to proceed," Habba affirmed.
"The government has nothing to hide at this facility, and I will personally accompany the mayor so he can see that firsthand," she added, inviting Baraka to personally inspect the detention center. Habba went on to say, "The people of New Jersey deserve united leadership so we can get to work to keep our state safe."
