Breaking: OSHA Drops Emergency ‘Vaccinate or Test’ Rule

According to the MedPage Today, “The Occupational Safety and Health Administration (OSHA) decided that it will work on developing a permanent standard for COVID after withdrawing its rule requiring workers at companies with 100 or more employees to either get vaccinated for COVID-19 or be tested for COVID at least once a week.

OSHA announced on its website Tuesday (Jan. 26) that its withdrawal from the emergency temporary standard (ETS), issued on Nov. 5, 2021, will be effective January 26, 2022. OSHA also added: “although OSHA is withdrawing the vaccination and testing ETS as an enforceable emergency temporary standard, the agency is not withdrawing the ETS as a proposed rule. The agency is prioritizing its resources to focus on finalizing a permanent COVID-19 Healthcare Standard. OSHA strongly encourages vaccination of workers against the continuing dangers posed by COVID-19 in the workplace."

OSHA’s decision follows the Supreme Court ruling against the mandate earlier this month, in which the high court wrote in an unsigned 6-3 opinionalthough Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly. Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category."

OSHA’s withdrawal announcement is good news because now more than ever, workers from all backgrounds across the country need commonsense, evidence-based protections against COVID-19 infection, hospitalization, and death; especially those who are immunocompromised or cannot get vaccinated due to a medical condition or religious purposes.
